The Prevention of Domestic Violence Act (PDVA) of New Jersey provides legal protection to victims of domestic abuse. Enacted in 1991, the law defines domestic violence as various criminal acts, including assault, harassment, stalking, terroristic threats, and more, committed by a spouse, former spouse, household member, or someone in a dating relationship.
Victims can seek immediate protection by filing for a Temporary Restraining Order (TRO) in the local Family Court or with the police. This order may grant emergency relief, such as prohibiting contact, removing the abuser from a shared residence, and addressing custody issues. A hearing is scheduled within 10 days to determine if a Final Restraining Order (FRO) is warranted.
